1 - DESCRIPTION OF THE SERVICE

Linkleek (hereinafter referred to as "the Service") is published within the meaning of the law for confidence in the digital economy by the SARL LINKLEEK, identified in the Melun trade register under the number 853 911 188 00011 (hereinafter referred to as "the COMPANY") and the client or visitor who has not subscribed to the pro Linkleek service (hereinafter referred to as "the User").

The acquisition of a product through the present site implies an unreserved acceptance by the buyer of the present conditions of sale.

  1. Subject

The version of the general terms and conditions of sale opposable to the customer is the one accepted by the latter at the time of the validation of his order. Online documents accepted at the time of order take precedence over all paper versions of earlier dates.

The general terms and conditions of sale are subject to change at any time.

They then apply to orders placed after they have been put online.

All sales operations presuppose consultation, understanding and acceptance of these general terms and conditions.

  1. Conditions of access and identification to the site

Access to the site is free to any user with internet access.

The site is accessible 24 hours a day, 7 days a week.

However, LINKLEEK reserves the right, without notice or compensation, to temporarily or permanently close the site or access to one or more remote services, in particular to carry out an update, maintenance operations, modifications or changes to operational methods, servers and hours of accessibility, without this list being exhaustive.

LINKLEEK shall not be liable for damages of any kind that may result from such changes and/or temporary unavailability or permanent closure of all or part of the site or the services associated therewith.

LINKLEEK reserves the right to add to or modify, at any time, the customer area and the services available there in accordance with the evolution of technology.

  1. Ordering, identification and acceptance of the general terms and conditions

The customer wishing to order on the site undertakes to communicate beforehand the information requested from the forms available online.

In addition, the customer certifies the truthfulness and correctness of the information thus transmitted.

The contractualization procedure consists of the following steps:

- Step 1: filling the basket ;

- Step 2: access to the details of the order in the basket. At this stage, the customer has the possibility to check the details of the order and its total price, modify it, correct any errors or cancel the order;

- Step 3: referencing the mandatory fields of the identification and information forms (including delivery and billing addresses). The customer can always access his profile, identify errors in the data entry and correct or cancel the order;

- Step 4: acceptance of the general terms and conditions of sale before validation of the order;

- Step 5: payment of the order.

The site acknowledges receipt of the customer's order by sending an e-mail without delay.

  1. Choice of products

The customer chooses the products presented in real time on the site on the day of the order.

The customer acknowledges having taken note of the nature, destination and terms of use of the products available on the site and having requested and obtained the necessary and/or additional information to place his order in full knowledge of the facts.

The customer is solely responsible for the choice of the Products and their suitability for his or her purposes, and LINKLEEK shall not be held liable in this respect.

The total or partial inability to use the products, in particular due to incompatibility of equipment, shall not give rise to any compensation, reimbursement or liability on the part of LINKLEEK, except where required by law.

  1. Collection and processing of personal data

The personal data collected and subsequently processed by the COMPANY, from the Service, are in particular those that the User sends to it via the Service registration forms. In accordance with the law number 78-17 of January 6, 1978 relating to data processing, files and liberties, the User has a right of information, opposition, access and rectification to the data concerning him/her.

  1. Delivery

Delivery times are specified to the customer on each product sheet and adapted according to the country.

Processing time + Delivery

- FRANCE (excluding DOM): 5 to 8 working days

- INTERNATIONAL: 5 to 12 working days

The products are delivered to the address indicated by the customer on the order interface.

Delivery is made internationally except for the following countries: Cuba, Iran, Iraq and North Korea.

All risk of loss of or damage to the Goods shall pass to the Customer when the Customer or a third party designated by the Customer, other than the carrier offered by LINKLEEK, takes physical possession of the Goods.

International delivery :
Customs charges may apply to international shipments. Since customs policy is different in each country, fees may vary depending on factors such as weight, value and/or size.

The customs charges, will not be taken in charge by our shop.

  1. Awards

The prices are displayed in euros and include VAT.

They are only valid for the period during which they are accessible electronically in real time on the sales area for the product in question.

They may change according to several criteria, particularly in the case of commercial transactions.

The value of the transaction will necessarily be that of the date and time of the order by the customer, the parties acknowledging that they have no recourse in the event of a decrease or increase subsequent to the order.

The prices displayed on the site do not take into account delivery costs, which will be indicated in addition to the price including VAT.

The prices take into account the VAT applicable on the day of the order and any change in the rate applicable to the VAT will automatically be reflected in the prices of the products in the sales area.

Before the confirmation of the order by the customer, the total amount of the order (price incl. VAT + delivery costs) will be indicated in euros.

  1. Payment

To settle his order, the customer has the following payment methods: Visa and Mastercard.

  1. Right of withdrawal: time limits and scope

The customer has a period of fourteen (14) clear days to declare that he wishes to return products that do not suit him, without having to justify his decision.

This period shall begin to run from the day of receipt of the goods by the customer or a third party, other than the carrier, designated by the customer.

If this period expires on a Saturday, Sunday or a public holiday or non-working day, it shall be extended until the first following working day.

  1. Product Compliance, Returns and Refunds

The customer is informed that he will have to bear the direct costs of returning the product.

The product must be returned in new condition, in its original packaging or in accordance with the shipment of your product and accompanied by the reason for return to the following address:

All claims for poorly printed / damaged / defective items or packages lost or in transit must be submitted within 14 days of receipt of the product or the assumed date of receipt.

For any complaint and reason mentioned above, it will be necessary for you to use our instant messaging service provided at the bottom of the page of the purchase site under Customer Service.

It will be necessary to attach the photo of the product in question and the number of your order. We will then proceed to replace the item or refund to the e-wallet available in your customer area. Valid for 1 year.

No refunds will be made following a change of heart.

Concerning the choice of sizes we strongly advise you in case of hesitation, to consult the size guide at your disposal, on the product sheets or directly via our instant messaging service provided at the bottom of the "after-sales service" page of the purchase site.

Refunds are made only for the following reasons :

  • incomplete order
  • item different from the one ordered
  • delay in delivery

 

  1. Responsibility

LINKLEEK cannot be held responsible for the non-performance of the contract due to a case of force majeure (in particular disruption or total or partial strike, especially of postal services and means of transport or communications) or to the fault of the customer.

LINKLEEK shall also not be held liable when the poor execution of the contract is attributable to the unforeseeable and insurmountable fact of a third party to the contract.

  1. Evidence and agreement of evidence

The online acceptance of the general terms and conditions constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.

The computerized registers kept in the computer systems of the company LINKLEEK will be kept in reasonable conditions of security and considered as proof of communications, orders and payments between the parties. They are authentic until proven otherwise.

Orders and invoices are archived on a reliable and durable medium that can be produced as proof.

  1. Nullity

If one or more stipulations of the present general conditions are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain their full force and scope.

  1. Applicable law and jurisdiction

These Terms and Conditions follow French law. The parties submit, at their option, for the resolution of disputes and with waiver of any other code, to the courts of the user's address.

  1. Modification

LINKLEEK reserves the right to modify the content of this legal notice at any time and without prior notice.

The user is therefore invited to consult it regularly.

  1. SERVICE DESCRIPTION

Linkleek (hereinafter referred to as "the Service") is published within the meaning of the law for confidence in the digital economy by the SARL LINKLEEK, identified in the Melun trade register under the number 853 911 188 00011 (hereinafter referred to as "the COMPANY") and the subscriber of the service. 

The subscriber of the service accepts the present general terms and conditions of sale.

 

  1. SUBJECT

The version of the general terms and conditions of online sale are the one accepted by the subscriber at the time of validation of his order until the date of renewal of the service, i.e. 1 year.

Changes may be made to the terms and conditions of sale on the renewal date of the service.

The new general terms and conditions of sale will then apply from the renewal of the service.

All sales operations presuppose consultation, understanding and acceptance of these general terms and conditions.

 

ARTICLE 3. CONDITIONS OF ACCESS AND IDENTIFICATION TO THE SITE

Access to the site is free to any user with internet access.

The site is accessible 24 hours a day, 7 days a week.

In order to improve the service, maintenance operations can take place during off-peak hours.

 

ARTICLE 4 - FINANCIAL PROVISIONS (Commission on Sale, Royalty or Royalty )

 

The amount of the User's royalties are accounted for over a period of (30) days and paid out between the 1st and the 10th of the following month.

 

Royalty payments are made by secure online transfer.

 

The royalty grid can be consulted at the bottom of the FAQ page or via the user interface.

 

Sales and details of royalties collected can be viewed via the user interface. The subscriber bears the costs of the start-up and subscription fees. 

ARTICLE 5 - OBLIGATIONS OF THE COMPANY

5.1 The COMPANY undertakes to ship the Products sold in accordance with the general terms and conditions of sale of the Service.

5.2 The COMPANY undertakes to deal with customer complaints regarding orders for Products sold under the Service.

The COMPANY undertakes to manage any exchanges, returns and refunds of Products.

5.3 The COMPANY undertakes to insure at its own expense (in particular in the event of fire, explosions, sabotage, theft and water damage) the Products which are in storage on its premises, provided that the subscriber of the service has sent it a declaration of value for its Products.

 

ARTICLE 6 - OBLIGATIONS OF THE SUBSCRIBER OF THE SERVICE

6.1 The service subscriber declares that he is the holder, agent and/or assignee of all the rights relating to the promotion of his activity (visuals, concert dates, promotional content, video excerpts, audio rights, copyright and related rights of performers and producers).

The subscriber of the service furthermore undertakes to ensure that any audio and/or video content reproduced on the Recording Media does not in any way infringe the rights held by third parties and guarantees the COMPANY of any recourse in this respect.

6.2 the service subscriber declares that he is the holder, agent and/or assignee of all the intellectual property rights (in particular including so-called "merchandising" rights) necessary for their exploitation in accordance with the present terms and conditions. 

The service subscriber also declares that he holds all intellectual property rights (including copyrights, trademarks, etc.) relating to the Associated Elements as well as all rights relating to the name, pseudonym and/or image of the groups or artists with a view to their use, in accordance with the present terms and conditions, from the Service. The subscriber of the service expressly indemnifies the COMPANY against all claims by third parties (including artists, producers, licensees etc.) in this respect.

6.3 The subscriber of the service is solely responsible for the contents transmitted to the COMPANY for publication.  

 

ARTICLE 7 - COLLECTION AND PROCESSING OF PERSONAL DATA

The personal data collected and subsequently processed by the COMPANY, from the Service, are in particular those that the subscriber of the service transmits to it via the Service's registration forms. In accordance with the law number 78-17 of 6 January 1978 relating to data processing, data files and liberties, the subscriber of the service has the right to information, opposition, access and rectification of data concerning him/her.

All information and documents transmitted by the subscriber of the service to the COMPANY is confidential.

ARTICLE 8 - DELIVERY

8.1 Service Delivery

The order is executed, on the date or within the period indicated by the subscriber and, if not indicated, within a maximum period of thirty (30) days at the latest upon receipt of all the documents.  

8.2 Product delivery

Delivery times are specified to the subscriber of the service when placing the order, according to the delivery method and address chosen.

The products are delivered to the address indicated by the customer on the order interface. Delivery is made internationally except for the following countries: Africa, Cuba, Iran, Iraq and North Korea.

The different fees and delivery terms are presented on the site.

Any risk of loss or damage to the goods shall pass to the customer at the time the customer, or a third party designated by the customer, is other than the COMPANY's proposed carrier taking physical possession of the goods.

 

  1. PRIZE

9.1 Service subscription

The prices are displayed in euros and are exclusive of VAT.

9.2 Product purchase

The prices relating to the order of the products are indicated on the online sales area dedicated to this purpose.

The prices are displayed in euros and include VAT.

The prices displayed on the site do not include delivery charges.

Before confirmation of the order by the subscriber of the service, the total amount of the order (price incl. VAT + delivery costs) will be indicated in euros.

 

  1. PAYMENT

9.1 Service subscription

To pay for his order, the subscriber of the service has the following payment methods: Visa and Mastercard.

As soon as the subscription is made and validated by the banking operator, a confirmation of payment and a summary is sent by e-mail to the subscriber of the service.

9.2 Product purchase

  1. PRODUCT COMPLIANCE, RETURNS AND REFUNDS

  1. NULLITY OR TERMINATION

If one or more stipulations of the present general conditions are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain their full force and scope.

The Service subscriber may decide to suspend the use of the Service on the anniversary date of subscription by simply unsubscribing. In the event that the service subscriber wishes to terminate his subscription before the end of the commitment period, the service subscriber must notify the COMPANY by e-mail or by registered mail at least 1 month before the end of his subscription.

In the event of unsubscription prior to the termination date, the subscriber will be liable for the amount of the subscriptions for the period from the subscription start date to the date of the request to terminate the service. In the event of termination of use of the Service, the COMPANY will send the subscriber of the Service within a reasonable period of time an up-to-date statement of the payment of his subscription .

 

  1. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions follow French law. The parties submit, at their option, for the resolution of disputes and with waiver of any other code, to the courts of the address of the subscriber of the service.

 

  1. SERVICE UPDATE

The subscriber of the service is invited to regularly consult the general terms and conditions of sale in the event that these are updated by the COMPANY.
